If a former employer charges that you were discharged because of misconduct, you can request a hearing. There are non-profit orgs that will help contest a misconduct claim. There is also information on the NYDOL site which shows that your can remove a disqualification for misconduct by subquently working and earning more than 5 times your benefit rate |

What organizations can help you contest a misconduct claim? Ok, maybe the Legal Aid society. But I work for the NYS DOL (and CWE --its complicated!) and have never heard of any for the 2 years I have worked at the Queens One-Stop. Some employers try to really take advantage of people and file frivilous claims of misconduct. This information we certainly help me help some of these people |
